🎉 BIG NEWS for Texas Home Bakers! Major Cottage Food Law Updates You Need to Know 🎉

If you’re a Texas cottage baker (or dreaming of becoming one), it’s time to CELEBRATE because the Texas Cottage Food Laws just got a game-changing upgrade!

Here at Sweet Kravings, we’re all about empowering home-based bakers to build sweet empires from their kitchens—and these updates make that dream even more possible. Let’s break down what’s new and why it’s such a big deal for the Cottage Food community in Texas.

🚀 BIGGEST WIN: Income Cap Raised to $150,000!

Yes, you read that right! As of September 1st, 2025 the annual gross income cap for Cottage Food businesses in Texas has officially increased to $150,000 per year. This means you can now scale your home bakery further without needing a commercial kitchen or food manufacturing license.

More room to grow = more sweet success. đŸȘ💰

🧁 Hello Refrigerated Desserts – You’re Now LEGAL!

One of the most requested changes has finally happened: Refrigerated desserts are now allowed under Texas Cottage Food Law! That means you can legally sell items that need refrigeration, like:

  • Cheesecakes
  • Cream pies
  • Tiramisu
  • Whipped cream frostings
  • Custard-based desserts

As long as you’re following safe handling and temperature guidelines, you’re now able to offer even more variety to your customers—and increase your profit potential.

đŸȘ Sell to Retailers, Coffee Shops & More!

This is HUGE: Texas cottage food operators can now sell directly to retailers and cafés. That means your home-baked goodies can now sit proudly on the shelves of your favorite local coffee shop, boutique, or small grocery store.

This opens the door to incredible B2B opportunities and helps expand your customer base beyond just direct-to-consumer sales. Your kitchen just became a small-batch production studio—and your brand can now be everywhere.

This law allows for almost any food products with a few exceptions:

  • Meat, Poultry or Seafood
  • Low-Acid Canned Goods
  • Ice or Iced Products
  • Products Containing CBD or THC
  • Raw Milk or Raw Milk

Texas no longer requires permits, licenses or fees from home producers. In addition to allowing the removal of home addresses from labels by registering with DSHS.

🔍 Quick Recap of the Key Updates:

  • Income limit increased to $150,000/year
  • Refrigerated baked goods are now permitted
  • Retail and wholesale sales to cafĂ©s, shops, and markets allowed
  • No permits, licenses or fees from home producers
